The federal lawsuit, filed in California, accuses Meta of employing AI systems to evaluate employee performance and activity data for layoffs, resulting in an alleged bias against individuals on maternity leave, medical leave, or with disabilities. The plaintiffs argue that these AI-driven assessments contributed to a workforce reduction earlier in the year that impacted approximately 8,000 employees.
The complaint highlights that Meta’s AI systems replaced traditional managerial evaluations, which the plaintiffs believe led to lower performance scores for those on approved leave. This has allegedly resulted in workers on family or medical leave, or those receiving disability accommodations, being disproportionately affected by the layoffs. Among the plaintiffs is a scientist who was laid off just two days before she was due to give birth, an engineer whose performance rating reportedly suffered due to injury recovery time, and a manager who was dismissed shortly after starting medical leave.
In their legal action, the employees are seeking a court-ordered pause on the layoffs while the case is in progress. They are demanding reinstatement, compensation for lost wages and benefits, and an independent review of the AI systems used by Meta. The case underscores the growing concerns about the potential for bias in AI systems used for workplace decisions, with critics cautioning that such technology could adversely affect employees who are legally entitled to certain types of leave.
Meta has responded to the lawsuit by denying the allegations.
